Consultation Terms & Conditions

This limited consultation agreement is made between Nazareth Innovative Law PLC and the person who has completed the intake and form order for this consultation (hereinafter referred to as "Potential Client").

I. Scope

By virtue of this agreement, Nazareth Innovative Law agrees to provide consultation, not to exceed the time selected in the form order, with the Potential Client, for purposes of offering the service of legal advice. Said consultation will in no way resolve the potential client's issue, as matters of strategic paths to resolution require a written and customized retainer agreement after an agreement of the parties (Nazareth Innovative Law PLC and Potential Client). If Nazareth Innovative Law PLC discovers and confirms that a conflict would prevent the consultation from taking place, a member of our staff will notify you in writing and a refund of the consultation fee will be processed. Nazareth Innovative Law PLC should not be referenced as counsel of record on any matter by virtue of this consultation agreement alone.

II. Cost

The incremental consultation fee is in exchange for the reservation of time in our office and is not a rate or reduced rate of service. Nazareth Innovative Law PLC reserves the right to credit all or part of the consultation fee to a subsequently scheduled appointment, should a good cause be shown to do so. Nazareth Innovative Law PLC further reserves the right to deny a credit request. No-show appointments will not be refunded to the Potential Client. All consultation fees must be paid in advance of the consultation. Failure to pay the consultation fee will result in your consultation appointment being canceled.

Nazareth Innovative Law PLC will apply the consultation fee as a credit towards a service discussed in the consultation within seven (7) days of the written retainer being signed. All written retainer agreements and service quotes will expire within seven (7) days of being transmitted by Nazareth Innovative Law PLC.

The Potential Client understands that this reservation of time is considered the product and/or service for purposes of communication to financial payment processors only. The documented attempt by Nazareth Innovative Law PLC to connect with the Potential Client at the scheduled time will suffice as having received said product and/or service and no refund will be issued.

In compliance with the Virginia State Bar, this consultation is a flat fee and earned in its entirety when Nazareth Innovative Law PLC places the call to the Potential Client at the agreed-upon and scheduled time.

III. Confidentiality

Nazareth Innovative Law PLC will not share any information obtained in the consultation with the Potential Client with any third party without the Potential Client's consent or a court order. If anyone other than the Potential Client attends the consultation (via conference call, speakerphone, etc.) the limited confidentiality privilege is waived.

*Employees, agents, and verified independent contractors of Nazareth Innovative Law PLC may have access to limited information to perform their job duties*

IV. Dispute Resolution

If any dispute arises out of or related to a claimed breach of this Agreement or any other disagreement of any nature, type, or description regardless of the legal theories that may be involved, such dispute shall be resolved by binding arbitration by a single arbitrator or a team selected by the Virginia State Bar, before the Commonwealth of Virginia. Each side shall bear its own cost and attorneys' fees. The parties agree to waive their right to a jury trial. The parties both further agree that prior to arbitration, the parties will make a good-faith effort to resolve the dispute without the necessity of outside intervention. Potential Client agrees that in order to be considered a good faith effort, the Potential Client must give Nazareth Innovative Law PLC a written notice of any dispute about costs, fees, or expenses within three (3) business days of the date that Potential Client receives Nazareth Innovative Law PLC's invoice or said grievance comes into existence. If instead, the Potential Client breaches this agreement and initiates a charge-back this, along with all other relevant evidence to dispute said chargeback will be submitted to the relevant entity and the confidentiality, as it relates to the dispute, is deemed waived by the Potential Client.

V. Disclaimers

Nothing in this Agreement and nothing in Nazareth Innovative Law PLC's statements to the Potential Client shall be construed as a promise or guarantee about the outcome of the matter. Nazareth Innovative Law PLC makes no such promises or guarantees. Any comments made by any legal personnel of Nazareth Innovative Law PLC about the outcome of the matter are expressions of opinion only. Any estimate of fees given by legal personnel of Nazareth Innovative Law PLC shall not be a guarantee. Actual fees may vary from the estimates given. Only fees quoted by Attorney Shea Nazareth, via a written invoice and accompanied by a written retainer agreement shall be binding on Nazareth Innovative Law PLC.

If any provision of this Agreement is held, in whole or in part to be unenforceable for any reason, the remainder of that provision and of the entire agreement will be severable and remain in full force and effect.
